These Terms and Conditions apply to all photography services and products provided by Footprints Photography ("we", "us", or "our"), a UK-based school photography company. Please read them carefully before placing an order.

1. Definitions
Company refers to Footprints Photography.
Customer refers to a parent or legal guardian who places an order.
Student refers to the child being photographed.
Services refers to school photography sessions, image processing, online galleries, digital downloads, and printed products.
Website refers to our official Footprints Photography website and online ordering platform.
 
2. Acceptance of Terms
By accessing our Website, viewing galleries, or placing an order, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you must not use our Services.

 
3. Eligibility and Authority
You confirm that you are at least 18 years old and are the parent or legal guardian of the Student, or otherwise have legal authority to purchase images and grant consent on the Student’s behalf.

 
4. Photography Sessions
Photography sessions are organised in cooperation with schools or nurseries.
We are not responsible for missed photographs due to student absence, refusal, illness, or school scheduling changes.
We reserve the right to reschedule or cancel sessions due to circumstances beyond our control, including weather, illness, or equipment failure.
 
5. Orders, Pricing, and Payment
All prices are displayed in GBP (£) and include VAT where applicable.
Orders must be paid in full at the time of purchase via our secure online system.
Once an order has entered production, it cannot be cancelled or amended.
 
6. Digital Images and Delivery
Digital images are provided via secure online download.
Customers are responsible for downloading and securely storing purchased digital files.
We do not guarantee indefinite storage of digital images.
Colours may vary slightly between screen displays and printed products.
 
7. Refunds, Returns, and Replacements
All photography products are personalised and therefore non-refundable, except where goods are faulty or incorrect under the Consumer Rights Act 2015.
Any issues must be reported within 14 days of receipt.
Approved replacements or reprints will be issued at our discretion.
 
8. Copyright and Usage Rights
All photographs remain the intellectual property of Footprints Photography.
Customers receive a non-exclusive, non-transferable licence for personal, non-commercial use only.
Images may not be edited, sold, shared with third parties, or used commercially without written permission.
 
9. Marketing and Model Release
We may use images for portfolio, website, or social media purposes only where appropriate consent has been obtained.
Parents or guardians may opt out of marketing usage by notifying us in writing or via email.
 
10. Privacy and Data Protection
We process personal data in accordance with UK GDPR and the Data Protection Act 2018.

11. Limitation of Liability
To the fullest extent permitted by law:

We are not liable for indirect or consequential losses.
Our total liability is limited to the amount paid for the relevant order.
 
12. Indemnity
You agree to indemnify and hold Footprints Photography harmless from any claims arising from misuse of images or breach of these Terms.

 
13. Force Majeure
We shall not be liable for delays or failures caused by events beyond our reasonable control.

 
14. Changes to These Terms
We reserve the right to update these Terms at any time. The current version will always be available on our Website.

 
15. Governing Law
These Terms and Conditions are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
